The EU AI Act The EU AI Act introduces a risk-based framework for AI-powered dash cameras, with obligations that vary depending on the system’s functionality 8 . For high-risk applications (e.g. AI systems that leverage biometric information or are intended to be used to make decisions affecting terms of work-related relationships ), fleets must ensure: • Human oversight: using AI insights as a supportive resource and not as a conduit for automated decision making or a substitute for human decision making and oversight • Transparency: clearly communicating what is monitored and why • Data governance: using accurate and relevant data • Accurate documentation: maintaining records to demonstrate compliance Even for lower-risk systems, the AI Act emphasises accountability and reliability, requiring fleets to monitor AI performance and address potential biases or errors in real-world use. We monitor the EU AI Act, related delegated acts, and forthcoming Commission guidance, and we are building our internal AI governance program to be capable of meeting EU AI Act requirements when they come into force.
National privacy and workplace monitoring laws EU Member States have introduced national laws to complement GDPR, particularly in areas such as employment. While these laws do not alter the core GDPR principles, they may impose additional requirements on workplace monitoring, including consultation obligations and restrictions on surveillance practices. This means that while the legal framework is harmonised at the EU level, practical expectations can vary, particularly in countries with strong worker representation structures. Effectively, this establishes different countries as being more or less cautious of the use of certain dash cameras’ AI features, such as driver monitoring, driver authentication and continuous recording. For example, in Germany, works council approval is mandatory for workplace monitoring under Betriebsverfassungsgesetz (BetrVG) § 87 9 . In order to balance the safety benefits of AI-powered dash cameras with their legal obligations, organisations must ensure a structured, defensible approach to implementation.
