E xecutive summary: Navigating a compliance paradox Last mile fleet operators must continually enhance fleet safety to remain compliant with evolving safety legislation and safeguard their drivers from the risks posed by demanding work schedules and busy roads. Equally, organisations have a clear duty of care to their workforce and must provide their drivers with the support and tools they need to be safe. These combined forces have accelerated the transition from traditional telematics-based fleet safety programmes to those supported by AI-powered video solutions. AI video telematics is a potentially life-saving technology that proactively mitigates high-risk behaviours to protect the driver and other road users. Tangible benefits such as a reduction in collisions, insurance claims, and unsafe driving events demonstrate the value of adding a video layer to a traditional telematics solution. However, fleet operators across the EU must tread carefully to ensure that any new video telematics system complies with applicable legislation, such as GDPR, the EU AI Act, and individual countries’ data protection, privacy, and labour laws. The risks of not doing so can be significant. For example, failure to comply with core GDPR principles can expose organisations to fines of up to 4% of global annual revenue 1 . This creates a compliance paradox. Driver error is the principal cause of road traffic accidents, with research from traffic safety studies finding it to be involved in up to 95% of accidents 2 . Yet many fleets are hesitant to employ the tool that can proactively mitigate this risk, for fear of breaching one of these laws.
